2. The personal data entrusted to us is processed and secured in accordance with security requirements.

Data Collection

1. Browsing the Service content does not require providing Personal Data by the User.
2. Providing personal data by the Customer is necessary for proper registration of the Customer’s account on the website. Failure to provide personal data prevents the execution of the above action and its accompanying processes.
3. The basis for processing personal data is the consent of the Customers themselves (art. 6 para. 1 lit. a) GDPR) (you have the right to withdraw consent at any time without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal).
4. Personal data entrusted to us is used for purposes related to:◦ 4.1 Registration of the Customer’s account on the website: legal basis: art. 6 para. 1 lit. a) GDPR
   a. Marketing activities and transmission of commercial information (we process this data until you withdraw the consent provided to us)
   ◦ 4.2 Execution of purchase and sale transactions: legal basis: art. 6 para. 1 lit. b) GDPR
   a. Account maintenance on the website (we process this data until the account is deleted from the system)
   b. Conclusion of the Service Provision Agreement (we process this data for the duration of the agreement)
   c. Provision and delivery of services (we process this data until the order is completed)
   d. Settlement of financial transactions and protection and enforcement of claims (we process this data for the duration of financial obligations or claims),
   e. Communication with the Customer related to service management (we process this data until complaint obligations are completed).

   a. Issuance and storage of sales documents and accounting documents (we process this data for the period required by law)
   b. Consideration and handling of complaints (we process this data for the period of warranty on purchased services).

   a. Creation of internal analyses, reports and statistics (we process this data for a period of 10 years)
5. Provision of Personal Data by the User may be necessary in other justified circumstances, e.g., submission of a request for transmission of specific information, of which the User will be informed each time.
6. If the User uses the website using mobile devices, device identification data, internet service provider and subscriber data may be obtained; however, data collected in this manner will only be used for statistical purposes or to ensure proper use of the website.
7. Information directly related to browsing website content is also collected, such as the user’s IP address, opened subpages, visit time, number of individual page views, number of visits, visit source; however, these serve only statistical purposes and improvement of website content and are not information used for direct identification of the User, unless necessary for the User’s proper use of the website.

Data Sharing

1. Personal data is not shared with other entities for marketing purposes.
2. Your personal data will be transferred to other data controllers who process it on their own behalf:
   a. Entities conducting payment activities for the purpose of making electronic payments, as well as for potential refunds on your behalf
   b. Entities cooperating with us in handling legal, tax and accounting matters
3. Customer data may be shared with entities authorized to receive it under applicable law, including appropriate judicial authorities.

Data Transfer Outside the European Economic Area

We currently do not transmit and do not plan to transmit your data outside the European Economic Area. However, it is possible that we may decide to transfer data outside the EEA to the extent permitted by law. Data Updates and Your Rights

1. In connection with our processing of your personal data, we inform you that you have the following rights:
   a. Control over data processing, including the right to supplement, update, temporarily or permanently suspend processing, correct and amend data,
   b. Deletion of data
   c. Restriction of data processing
   d. Access to data (information about data processed by us and copies thereof)
   e. Transfer of data to another data controller
   Regardless of the above rights, you may object at any time to the processing of your data for marketing purposes. Upon receipt of such objection, we are obliged to cease processing data for this purpose. This will not affect the lawfulness of data processing prior to withdrawal of consent.
2. To exercise your rights, you can:
   a. Perform appropriate operations in the Customer panel after logging in to our website
   b. Contact us using the contact information provided at the beginning of this document
3. In case of violation of the Service Terms and Conditions or Service Agreement, non-payment of fees to the Service owner, or violation of applicable law, and when data retention is necessary to clarify the circumstances of the situation, the Service Administrator may refuse to temporarily delete data.

Complaints

You have the right to lodge a complaint with the President of the Personal Data Protection Office if you believe that the processing of your data violates applicable law.

COOKIES

1. Heroswipe sp. z o.o. uses cookies (so-called “cookies”) – computer data, in particular text files, which are recorded by the server each time on the device used by the User. Heroswipe sp. z o.o. may also use technologies with functionality similar to cookies. Recorded cookie files typically contain: a unique number, the retention time on the User’s device, and the domain name of the server from which they originate.
2. Cookies are used by Heroswipe sp. z o.o. for the following purposes:
   ◦ Optimization of website content adaptation to User preferences, allowing recognition of the User’s device and presentation of websites in a form adapted to their needs
   ◦ Creation of statistics enabling the way the website is used by the user and allowing its content and structure to be improved
   ◦ Maintaining the session of a logged-in User’s internet browser, so there is no need to log in when moving to subsequent pages of the service
